RENTAL OF A FURNISHED FLAT BETWEEN THE UNDERSIGNED  Mr and Mrs DELCROIX Mathieu and Caroline, residing at 7 Chemin des Limons in AVANÇON (08300) Telephone number: 03 24 39 06 37 Mobile telephone number: 07 86 43 47 92 Email : [email protected] ; hereinafter referred to as " The Lessor " ON THE ONE HAND AND Mr and Mrs , residing at , Telephone number: Mobile telephone number: Email : ; hereinafter referred to as " The Tenant " ON THE OTHER HAND It has been agreed between the parties that the Lessor rents to the Tenant the accommodation as described below under the following conditions : 1. PURPOSE OF THE RENTAL AGREEMENT The parties declare that the purpose of this rental agreement is not to rent premises for use as a principal residence or for mixed professional and principal residence use. Consequently, they agree that their respective rights and obligations will be governed by the stipulations of the present contract, by the modified decree of 28 December 1976 and, failing that, by the provisions of the Civil Code. The premises, subject of the present contract, are rented furnished on a seasonal basis. 2. DESIGNATION OF THE ACCOMMODATION 105 LE PRALIN a. Address of the accommodation : Flat 105 (1st floor) Residence Le Pralin Le Châtelet 73550 MÉRIBEL MOTTARET b. Description of the accommodation : The entrance distributes a cabin area and a corridor, with cupboards, which leads to a bathroom, then the living room composed of a kitchen with dining area open on a living room giving onto a beautiful balcony of 6 m². Equipment : Living room : Sofa bed with pull-out bed + single sofa bed, coffee table and 100 cm LED TV. Kitchen: Fully equipped with dishwasher, microwave oven, ceramic hob, fridge, Nespresso, filter coffee machine, toaster and kettle, as well as crockery and kitchen utensils as listed in the inventory handed over on arrival. A table, four chairs and a stool. Cabin: Double bed bunk bed Bathroom: Bathtub, washbasin and WC Balcony (summer season): Deckchair, chairs, table and chairs for 4/6 persons Non-smoking flat, our four-legged friends are not allowed Private ski locker on the ground floor 3. Description of the accommodation : The entrance distributes a cabin area and a corridor, with cupboards, which leads to a bathroom, then the living room composed of a kitchen with dining area open on a living room giving onto a balcony. Equipment : Living room : Sofa bed with pull-out bed + single sofa bed, coffee table and 100 cm LED TV. Kitchen: Fully equipped with dishwasher, microwave oven, ceramic hob, fridge, Nespresso machine, filter coffee machine, toaster and kettle, as well as crockery and kitchen utensils as listed in the inventory handed over on arrival. A table, four chairs and a stool. DESIGNATION OF THE ACCOMMODATION 411 LE PRALIN a. Address of the accommodation : Flat 411 (4th floor) Residence Le Pralin Le Châtelet 73550 MÉRIBEL MOTTARET b. Description of the accommodation : The entrance with cupboards distributes a bedroom and a corridor which leads to a separate toilet, a bathroom, then the living room composed of a kitchen with dining area open on a living room giving onto a south facing balcony. Equipment : Living room : Sofa bed with pull-out bed + bed warmer, coffee table and 100 cm LED TV. Kitchen: Fully equipped with dishwasher, microwave oven, ceramic hob, fridge, filter coffee machine, toaster and kettle, as well as crockery and kitchen utensils as listed in the inventory given on arrival. A table, four chairs and a stool. Bedroom: Double bed with bedside tables Bathroom: Bath, washbasin, WC Balcony (summer season): Deck chair Non-smoking flat, our four-legged friends are not allowed Private ski locker on the ground floor 5. DURATION OF THE SEASONAL RENTAL The Lessor rents the accommodation to the Tenant for the period from Saturday 2019 at 5pm to Saturday 2019 at 10am, i.e. 7 nights. The Tenant expressly undertakes to have fully vacated the accommodation by Saturday 2019 at 10am at the latest, and to hand over the keys to the Landlord or any person designated by the latter.6. OCCUPANTS OF THE ACCOMMODATION - TOURIST TAX Within the framework of a seasonal tourist rental, the Lessor is required to collect the tourist tax. This tax is payable by occasional residents and is exempt for minors. Calculation of the tax: (0.88 € for the 105 and 309 / 0.99 for the 411) per person per night. 7. RENTAL PRICE AND CHARGES The Parties have agreed to set the rent at € ( euros) for the entire duration of the rental period described in paragraph 3 (excluding options and tourist tax). The above rent includes, for the entire duration of the rental period, the payment of the rental charges and the available supplies listed below: - City water - Heating - Television access - End of stay cleaning in winter season Not included: - Cleaning in summer season - Bed linen and household linen - Tourist tax (0,88 € or 0,99 € per adult and per night) Optional and on reservation: - End of stay cleaning in summer season - Linen pack : 22 € per person (1 sheet, 1 duvet cover, 1 pillowcase, 1 terry towel, 1 bath sheet, bath mat and tea towel) - Childcare items on request Bank details (RIB) of the Lessor: Beneficiary: Mr or Mrs DELCROIX Mathieu Bank : Crédit Agricole NORD EST Bank code: 10206 Bank code: 08327 Account number: 98742899330 RIB key: 06 IBAN: FR76 1020 6083 2798 7428 9933 006 BIC: AGRIFRPP802 The Lessor shall, at the request of the Tenant, provide a receipt for any payment made. 8. RESERVATION In order to proceed with the reservation of the accommodation, the Tenant shall return the present contract initialled on each page and signed, accompanied by a deposit of 30% of the rent, i.e. € ( euros). This payment shall be made by bank transfer to the account of the Lessor indicated in paragraph 5. In the case of a reservation within 30 days prior to the entry into the accommodation, the totality of the rent and the tourist taxes shall be paid at the signature of the contract. 9. PAYMENT OF THE PRICE The balance of the rent indicated in paragraph 5, after deduction of the deposit, i.e. € ( euros), to which must be added the tourist taxes: 0,88 € or 0,99 € x major persons x 7 nights = €, i.e. a total of € ( euros) to be paid by the Taker at the latest 30 days before the entry in the accommodation. The Taker will make this payment by bank transfer. 10. GUARANTEE DEPOSIT or PRE- AUTHORISATION At the time of payment of the balance, i.e. at the latest 30 days before entering the accommodation, the Tenant will give the Landlord a cheque for the amount of € 400 (Four hundred euros) or a pre-authorisation of € 400 will be blocked on the credit card on the day of arrival in the accommodation as a guarantee deposit intended to cover damage and/or deterioration of the accommodation, furniture and objects furnishing the accommodation which would be caused by the Tenant, as well as the loss of keys or objects. The security deposit will be returned to the Tenant within a maximum of one month after his departure, after deduction, if applicable, of the sums covering the damage and/or deterioration of the accommodation, furniture and objects furnishing the accommodation that would be caused by the Tenant, as well as the loss of keys or objects. The security deposit may be constituted by the remittance of a deposit cheque signed to the order of the Landlord, which the latter shall return subject to the inventory and inventory of fixtures being in order when the keys are returned. 11. ASSIGNMENT AND SUBCONTRACTING The present rental contract is concluded intuitu personae in favour of the sole lessee identified at the head of the contract. Any transfer of the present lease, any total or partial subletting, any provision -even free of charge-, are strictly forbidden. The Tenant may not make the premises available, even free of charge and/or by loan, to a person outside his household.12. An inventory of fixtures and an inventory of the furniture made available to the Tenant shall be given to the Tenant upon entering the accommodation. If the inventory of fixtures and the inventory are not drawn up and signed by the Landlord, or his representative, and the Tenant simultaneously (contradictory inventory of fixtures and inventory), the inventory of fixtures and the inventory drawn up by the Landlord alone and given to the Tenant upon his entry into the accommodation may be contested by the Tenant within 48 hours following his entry into the accommodation. If the Tenant does not contest the inventory of fixtures and fittings made by the Landlord and communicated to the Tenant upon entering the premises within this 48 hour period, the inventory of fixtures and fittings shall be deemed accepted without reservation by the Tenant. An inventory of fixtures and an inventory shall be established by the Parties at the end of the rental period, each keeping a signed copy. In the absence of an inventory of fixtures and/or inventory at the end of the rental period or if the Tenant alone establishes the inventory of fixtures and/or inventory at the end of the rental period, the absence of any dispute by the Landlord within 48 hours following the end of the rental period shall be deemed to constitute the return of the premises in good condition and/or complete inventory. 13. DECLARATION OF THE LESSOR The Lessor declares that he is the owner of the accommodation and that he has free disposal and full enjoyment of it during the period defined in paragraph 3. At the Tenant's request, the Landlord may prove this by producing an EDF receipt, a property tax notice or any other official document. 14. TENANT'S OBLIGATION - The Tenant shall peacefully use the rented dwelling and the furniture and equipment according to the destination given to them by the lease and shall be responsible for any damage or loss that may occur during the term of the contract in the premises of which he has exclusive enjoyment. - The Tenant shall maintain the rented accommodation and return it in a good state of cleanliness and rental repairs at the end of the contract. If objects listed in the inventory are broken or damaged, the Lessor may claim their replacement value. - The Tenant shall avoid any noise likely to disturb the neighbours, in particular those emitted by radio, television and other appliances. - The Tenant may not exercise any recourse against the Landlord in the event of theft or damage to the rented premises. - The Tenant shall respect the maximum number of persons that may enter the premises, in accordance with the description that has been given to him. - The lessee may not object to the visit of the premises if the Lessor or his representative so requests. - Should the Tenant fail to return the accommodation in a perfectly clean state during the summer season, he/she undertakes to pay the sum of 50 € corresponding to the cleaning that the Landlord will be forced to carry out. (Note: the end of stay cleaning option is proposed to the Taker in paragraph 5). 15. CANCELLATION The signature of the contract commits both parties irrevocably. No cancellation is possible except by written agreement of the parties. If the Tenant cancels the rental within the last 30 days, he/she will still be liable for the full rent. In case of cancellation before the last 30 days, the Tenant will be liable for half of the rent, minus the deposit. It is specified that these conditions would not be applicable in case of force majeure of a pandemic type, such as COVID 19, which would force the regional and/or national authorities to confine and the resort of Méribel to close the ski lifts. Consequently, if this case were to occur, the tenant could, without charge, cancel his stay by writing to the lessor and would be reimbursed for the deposit and/or the balance already paid. This condition will not apply to any stay that has already begun. 16. INSURANCE At the time of payment of the balance, i.e. one month before entering the accommodation, the Taker must send the Lessor a certificate of Civil Liability insurance for the holiday home. 17. TERMINATION BY LAW In the event of failure by the Tenant to comply with any of the contractual obligations, the present lease shall be terminated by law. This termination will take effect after a period of 48 hours following a simple summons by registered letter which has remained unsuccessful and will result in the loss for the Tenant of the sums paid. 18. ELECTION OF DOMICILE For the execution of the present contract, the Landlord and the Tenant elect domicile in their respective residences. However, in the event of a dispute, the court of the Lessor's domicile shall have exclusive jurisdiction. This contract and its consequences are subject to French law.
